Liability & Privacy Policy

1. Liability Disclaimer

By booking or purchasing any service through Visual Lab Productions ("VLP"), you ("the Client") acknowledge and agree to the following terms:

1.1. General Disclaimer

VLP will exercise reasonable skill and care in providing photography and videography services at competitive events.
While all efforts will be made to capture high-quality media, VLP cannot guarantee specific results, angles, or moments due to the dynamic nature of live events.

1.2. Limitation of Liability

VLP shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or relating to the use or inability to use our services, products, or website.
Media files are stored for six (6) weeks from the date of delivery. VLP accepts no liability for files lost, damaged, or deleted after this period.
In the event of technical failure or loss of media within the six-week retention period, VLP will attempt recovery without charge. Retrieval after the retention period, if feasible, incurs a $75 administration fee.

1.3. Indemnification

You agree to indemnify, defend, and hold harmless Visual Lab Productions and its affiliates, officers, directors, employees, and contractors from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising out of:

Your breach of these Terms and Conditions;
Your misuse of any VLP services or media;
Any third-party claims relating to the use, distribution, or publication of media created by VLP on your behalf.

1.4. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to our services shall be resolved by binding arbitration under the laws of New South Wales, Australia.

The arbitration shall take place in Sydney, NSW.
Both parties shall bear their own legal costs unless otherwise ordered.
You waive the right to participate in class actions or jury proceedings.

2. Privacy Policy

VLP respects your privacy and complies with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs). This section outlines how we collect, store, use, and disclose your personal information.

2.1. Information Collected

We may collect personal information from you including:

Full name, email address, phone number, and postal address;
Event and booking details (e.g., competition date, division, music preferences);
Media content captured during events (photos, videos, audio);
Payment details (processed securely via third-party platforms);
Any other information voluntarily provided during communication or checkout.

2.2. Use of Your Information

We use your personal information for the following purposes:

To process and deliver services you have requested;
To contact you regarding your booking, orders, or changes to your service;
To improve our service offering and website experience;
To manage internal record keeping and compliance;
To send you notifications regarding future service updates, product releases, or important business changes.

2.3. Communication Consent

By providing your contact details, you consent to VLP adding them to our secure database for potential future communications regarding updates, promotions, or changes to our services and products.

You may opt out of these communications at any time by clicking the unsubscribe link in our emails or contacting us directly at info@visuallab.com.au.
We will never sell, rent, or share your personal contact details with unauthorised third parties.

2.4. Promotional Use of Media

Unless otherwise arranged in writing, VLP may use images and video recorded during events for marketing, portfolio, or promotional purposes.

You may opt out of promotional usage by submitting a written request at the time of booking.

2.5. Retention of Files

Digital media files (photos and videos) are stored securely for six (6) weeks following delivery.
After this period, all files are permanently deleted from our servers.
Retrieval of files after this time is not guaranteed and, if successful, may incur a $75 retrieval fee.

2.6. Data Storage and Security

Your personal data is stored on secure, access-controlled systems.
We use secure third-party payment processors (e.g., Shopify, Stripe, PayPal) to process all financial transactions.

2.7. Third-Party Access

We may engage trusted third parties for processing, hosting, or analytics, who will only access your data as necessary to perform services on our behalf.
All third parties must comply with the Australian Privacy Principles and maintain the confidentiality of your information.

3. Your Rights

You have the right to:

Access the personal data we hold about you;
Request correction of inaccurate or incomplete data;
Withdraw consent to promotional use or communication;
Lodge a complaint with the Office of the Australian Information Commissioner (OAIC) regarding concerns about your privacy.
